1. Acceptance of These Terms

These Terms & Conditions ("Terms") form a binding agreement between you and LivingTGR ("LivingTGR," "we," "us," or "the platform"), operated as an Elisda project. They govern your access to and use of livingtgr.com and all related services (collectively, the "Service"). By registering an account, browsing, or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Help & FAQ policies referenced within them. If you do not agree, do not use the Service.

2. Eligibility

• You must be at least 18 years old to create an account or use the Service.
• You must be legally capable of entering into a binding contract in your country of residence.
• You must not be barred from using the Service under the laws of your jurisdiction, or previously banned or suspended by us for a violation of these Terms.
• You agree to provide accurate, current, and complete information about yourself and to keep it updated.

3. What LivingTGR Is - and What It Is Not

Every match, message, date, relationship, agreement, or interaction that results from using the Service happens entirely between the members involved. LivingTGR is not a party to, and has no control over, what members say to each other, how they behave, what they agree to, or what happens if and when they choose to meet in person or otherwise interact outside the Service.

4. We Are Not Responsible for User Actions

Because LivingTGR only suggests matches and provides tools for members to communicate, we are not responsible or liable for the conduct, actions, statements, or omissions of any user, on or off the platform, including but not limited to:

• Inaccurate, misleading, or false information a user provides about themselves;
• Anything a member says or sends in messages, voice notes, photos, videos, or generated documents;
• The outcome, safety, or conduct of any in-person meeting, date, relationship, or arrangement between members;
• Financial, emotional, physical, or any other harm arising from an interaction with another member;
• Any agreement (including documents generated by the AI Relationship Contract Generator) that members enter into between themselves - such documents are a conversation starter, not legally binding contracts drafted or reviewed by LivingTGR;
• The actions of any user who misrepresents their identity, intentions, or relationship status, despite our screening efforts described below.

We do not conduct criminal background checks, and our automated and manual review processes (selfie verification, the AI Fake Profile Eliminator, and scam-pattern detection) are best-effort safety measures, not guarantees of any user's identity, honesty, intentions, or safety. You are solely responsible for your own interactions, decisions, and safety when using the Service.

5. Safety and Assumption of Risk

You acknowledge that meeting new people online and in person carries inherent risk. By using the Service, you assume full responsibility for your own safety and agree to exercise caution and good judgment, including:

• Never sending money, gift cards, cryptocurrency, or financial/account information to anyone you meet on LivingTGR, regardless of the reason given;
• Meeting new matches for the first time in a public place, and telling a friend or family member where you're going;
• Not sharing your home address, workplace, financial details, or other sensitive personal information until you're confident it's safe to do so;
• Reporting any user who asks for money, pressures you, or behaves suspiciously, using the reporting/contact options described in our Help & FAQ;
• Trusting your own judgment over any AI-generated compatibility score, insight, or recommendation - these are decision-support tools, not verdicts.

To the fullest extent permitted by law, you release LivingTGR, its owners, and Elisda from any and all claims, damages, or liabilities of any kind arising from your interactions with other users, whether online or in person.

6. AI Features Disclaimer

LivingTGR's AI-powered features (including but not limited to the Matching Engine, Compatibility Negotiator, Match Story Generator, Future-Prediction Simulator, Emotional Personality Engine, Breakup Risk Meter, Relationship Health Dashboard, Scam Risk Detection, Voice Personality Analyzer, AI Dating Coach, and the Relationship Contract Generator) generate results using artificial intelligence models based on the information you and other members provide.

• These features are provided for informational and entertainment purposes to support your own decision-making - they are not professional advice (legal, financial, medical, or psychological) and should not be relied on as such.
• AI-generated content can be inaccurate, incomplete, or reflect limitations of the underlying data or model - a compatibility score, risk assessment, or generated document is a suggestion, not a fact or a guarantee.
• The AI Relationship Contract Generator's output is explicitly not legal advice and does not create a binding agreement on its own; any document you intend to actually rely on should be reviewed by a qualified lawyer in your jurisdiction.
• Scam Risk Detection and the Fake Profile Eliminator are best-effort automated screens and will not catch every fraudulent profile or bad actor.

7. Your Account & Content

• You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it.
• You retain ownership of the photos, videos, voice notes, bio, and other content you upload ("Your Content"). By posting it, you grant LivingTGR a non-exclusive, worldwide, royalty-free license to host, store, display, and process Your Content solely to operate and improve the Service (including running it through our AI features).
• You represent that Your Content is genuinely yours, does not infringe anyone else's rights, and complies with these Terms.
• New accounts start on hold and are activated per our published membership process before matches and most AI features unlock.

8. Prohibited Conduct

You agree not to:

• Provide false information, impersonate another person, or misrepresent your identity, age, marital status, or intentions;
• Upload another person's photo, a stock image, an AI-generated face, or any image that does not genuinely show you;
• Harass, threaten, stalk, defraud, or attempt to extort money or information from another member;
• Use the Service for commercial solicitation, spam, or to promote another product or service;
• Post content that is unlawful, obscene, hateful, or infringes a third party's intellectual property or privacy rights;
• Attempt to circumvent our safety features, moderation, or the privacy protections described in our Help & FAQ (such as never displaying phone numbers publicly);
• Scrape, reverse-engineer, or use automated tools to access the Service or another member's data.

We may investigate and take appropriate action - including content removal, warnings, suspension, or permanent termination - against anyone who violates this section, at our sole discretion and without prior notice.

9. Membership & Payments

• Certain features require an active Premium membership, billed on the terms shown at checkout (currently processed securely through Stripe) and described on the Membership page and in our Help & FAQ.
• Introductory/trial offers, where available, are limited to one per account.
• You can cancel your subscription at any time from the Membership page; cancellation stops future billing but does not retroactively refund the current billing period unless required by applicable law.
• Pricing, free-listing limits, and feature availability are configurable by LivingTGR and may change - material changes will be reflected on the Membership page.

10. Intellectual Property

The Service, including its design, text, graphics, logos, software, and the LivingTGR name and branding, is owned by LivingTGR/Elisda and protected by applicable intellectual property laws. Except for Your Content, you may not copy, modify, distribute, or create derivative works from any part of the Service without our prior written consent.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, or that the Service will be uninterrupted, secure, error-free, or that any match, AI-generated insight, or outcome will meet your expectations.

12. Limitation of Liability

To the fullest extent permitted by law, LivingTGR, Elisda, and their owners, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses, resulting from:

• Your use of, or inability to use, the Service;
• Any conduct or content of any user, including any interaction, meeting, relationship, or agreement between members;
• Any AI-generated content, score, insight, or document produced by the Service;
• Unauthorized access to or alteration of your data, to the extent permitted by law.

Where liability cannot be fully excluded under applicable law, LivingTGR's total aggregate liability for any claim arising from your use of the Service is limited to the amount you paid us, if any, in the twelve months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless LivingTGR, Elisda, and their owners, employees, and affiliates from any claim, demand, loss, or damage, including reasonable legal fees, arising out of your use of the Service, your violation of these Terms, or your interaction with another user.

14. Termination

We may suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms, engaged in fraudulent or unsafe conduct, or for any other reason at our discretion. You may stop using the Service and request account deletion at any time; profile records may be retained internally for compliance and audit purposes even after your profile is marked deleted and hidden from other members.

15. Changes to These Terms

We may update these Terms from time to time to reflect changes to the Service or for legal reasons. We will update the "Last updated" date above when we do. Continued use of the Service after a change takes effect means you accept the revised Terms.

16. Governing Law

These Terms are governed by the laws of the United States, without regard to conflict-of-law principles, unless a mandatory law of your country of residence provides otherwise. Any dispute arising from these Terms or the Service will be subject to the exclusive jurisdiction of the courts having authority over that governing law.
